An Overview of Legal Issues Faced by Meat Goat Producers

Unit Objective

After completion of this module of instruction the producer should be able to use legal information and knowledge to protect and manage the family goat farm. The producer should be able to use legal documents when purchasing and selling products from the goat farm and to organize the farm operation using one of the many business entities. The producer should be able to score a minimum of 85% on the module test.

Specific Objectives

After completion of this instructional module the producer should be able to:

  1. Identify the two most common and serious sources of liability.
  2. Match the classification of entrant upon an owners land.
  3. State the meaning of the doctrine of “strict liability.”
  4. Distinguish between a nuisance and a public nuisance.
  5. State factors to consider when searching for landowner liability insurance coverage.
  6. Identify the two primary stages of a secured transaction.
  7. Identify when perfection of the security occurs.
  8. Define a bill of sale.
  9. State the components of a bill of sale.
  10. Distinguish between a good and a bad pasture and/or farm lease.
  11. Distinguish between a good and a bad production contract.
  12. Match the different type of business entities with their definition.
  13. State facts relating to the different types of business entities.
  14. Distinguish between trademarks and copyrights.
  15. State the purpose and intent of corporate farming laws.
  16. Identify information regarding farming cooperatives.
  17. Distinguish between contract laborers and employees.
  18. Identify factors to avoid receiving a bogus check.
  19. Distinguish between wills and trusts.
  20. Evaluate a producer’s options when dealing with a potential divorce.
  21. State the advantages of a pre-nuptial agreement.
  22. Respond to options that a producer may use when dealing with a potential bankruptcy.
  23. Respond to statements related to the Environment and the Clean Water Act.
  24. Respond to statements related to the Packers and Stockyard Act.
  25. Respond to statements related to urban sprawl.
  26. State the meaning of pro bono legal services.
